لا يخفى على مُطَّلعٍ للسَّاحة الفكريَّة المعاصرَة ما أُولي به علمُ الفكر من اهتمام كبير، سواءً كان تأليفًا فيه أو اطلاعًا عليه، وقد صارَ في هذا العصر عِلْمًا له كُتُبُه وكتَّابه ومؤسساته العلمية ومناهجه الخاصة، وأصبحَ للفكر عمومًا والفكر الإسلامي خصوصًا حضورًا طاغيًا بين الشباب المحبين للثَّقافة والاطلاع، إلا أنَّ علم الفكر الذي هو (التصور الإجمالي والتفصيلي لواقعٍ ما من حيث كنهه، وعوامل تكوينه، ومآلاته، وطرق تحسينه، وعلاج آفاته) علمٌ جديدٌ على الثَّقافة الإسلامية؛ لذا كانَ لزامًا أن يُحدَّد ويضبط بالضوابط الشرعية، فجاءَ هذا البحثُ لبيانِ العلاقة المفترضة -أو قل: المطلوبة من المفكرين المسلمين- بنصوصِ الوحيين: كتاب الله وسنة رسوله ﷺ. فلُبُّ البحث هو: ربطُ علم الفكر بالمُحكَّمات الشرعية، والانطلاق في التصورات الفكرية منها، فالمحكمات من الكتاب والسنة واضحاتٌ بيناتٌ للناس، ومتى ما بنينا عليها تصوراتنا الفكرية، وأرجعناها إليها، ضبطنا الفكر الإسلامي من أن يخرج عن مساره وغايته، وكان في ذلك صونٌ للفكر من أن يتعثر بالمزالق الفكرية، وممَّا ينبغي معرفته أنَّ من أعظم ما حدَّته محكمات الشريعة للعقل: استعمالُ العدل من أولي العلم والفكر فيما يقيمونه للناس من أمر دينِهم ودُنياهم، وخلاصة الأمر أن يقال: إن الفكر الإسلامي يجب أن ينضبط بالمحكمات الشرعية، وتسير في فلكها، وتحقق غاياتها؛ لنحقق الغاية المرجوة من علم الفكر.Preservation copy of the original JOIS article. إن انتهاء العصمة الزوجية بالطلاق وانقضاء العدة له آثاره المترتبة عليه، ومن بينها أن هذا الطلاق إن لم يكن بائنا بينونة كبرى - حسب التشريع الإسلامي-، أي كانت الطلقة الأولى أو الثانية، وتزوجت المرأة المطلقة من رجل آخر ولم يكتب بينهما طول عشرة وانتهت علاقتهما بطلاق أو وفاة، فهل إذا عادت إلى زوجها الأول يحتسب بينهما الطلاق السابق قبل زواج المرأة من الثاني الذي فارقته، أم إنّ الزواج الثاني يهدم الطلاق السابق؟ وقع خلاف قديم بين صحابة الرسول محمد صلى الله عليه وسلم والتابعين وأئمة المذاهب، ومردُّ الخلاف عدمُ وجودِ نصٍّ واضح من جهة، ولاحتمال الأدلّة الموجب للخلاف. في محاولة للملمة شتات الموضوع ورصد أقوال وأدلة الفقهاء وكذا اجتهاد القانونيين، يأتي هذا البحث ليحاول الترجيح بين القولين وفق مقاصد الشريعة والقواعد الكلية، ولو أن الحسم القاطع للخلاف مستحيل في مثل هذه المسائل، باعتبار أن الخلاف قديم والمسألة كانت محط اجتهاد الرعيل الأول. ولمعالجة هذه القضية سيقسم هذا البحث إلى مقدمة ومبحثين، الأول منهما في أقوال الذين يرجحون القول بعدم هدم الزواج الثاني للطلاق السابق من الزوج الأول واستدلالاتهم. والمبحث الثاني في أقوال القائلين بالهدم وأن الزواج الثاني يمحي آثار الزواج الأول مع ذكر أدلتهم وردودهم. مذيلا ذلك بآراء فقهاء القانون في المسألة، وخاتمة تجمع أهم النتائج المتوصل إليها.Preservation copy of the original JOIS article. يسعى هذا البحث إلى إبراز حكمة الشّريعة الإسلاميّة في انتشارها في جميع أنحاء العالم، فالشّارع الحكيم درَج في تعليم نبيّه ورسوله محمّد بن عبد الله القرشي صلوات ربي وتسليماته عليه بمنهج التّدرج في دعوته لكافة الأنام؛ لأنّه سبحانه وتعالى عليمٌ بمخلوقاته وطباعهم. وقد بعث الله النّبي محمداً والمسلمون آنذاك يشربون الخموركالماء، بل كان الخمر من أحب المشروبات لديهم؛ لذلك لو تمهد الداعيّة من تدريج الشّارع الحكيم في تحريم الخمر، لحصل له علم اليقين بأن الأنبياء والرسل قد درجوا في هذه الوظيفة المهمة مسلك التدرج، والنّبي محمد أسوة لأمته يقتدى به في كل شيء ما استطاعوا إليه سبيلاً. وقد انتهج الباحث المنهج الاستقرائي والتحليل لتحقيق مرامه. ومن أهم نتائج البحث أن الشريعة الإسلاميّة شريعة سمحاء لا جفاء ولا مشقة فيها، وأن يلبس الداعيّة لباس الصبر والحلم في دعوته، وأن يكون الداعيّة ملماً بالشّريعة الإسلاميّة قبل أن يخط أية خطوة في الدعوة.Preservation copy of the original JOIS article. إن موضوع البحث هو "غير المسلمين في الدولة المسلمة " ويهدف إلى بيان المفاهيم الصحيحة حول أصناف غير المسلمين في الشريعة الإسلامية وقد اهتم الإسلام بغير المسلمين ووضع ضوابط خاصة للتعامل معهم حتى تكون هناك بصيرة في تعامل المسلمين معهم ، وغير المسلمين أنواع فمنهم : 1- غير المسلمين خارج الدولة المسلمة وهم أنواع أيضا ومنهم: 2- غير المسلمين في داخل الدولة المسلمة فهم أهل الذمة والمستأمنون، والمهم في هذا البحث هو تحديد مفهوم الدولة المسلمة عند فقهاء الإسلام ، حتى نستطيع أن نحدد أصناف غير المسلمين الموجودين في هذه الدولة بوضوح ، وحتى يعرف كل مسلم كيف يتعامل مع كل صنف منهم بكل وضوح وبصيرة، والإسلام يتعامل مع الأديان والشعوب والحكام على أساس الوسطية والاعتدال وعلى ميزان التسامح والإحسان والمعاملة بالمثل وإيصال سماحة الإسلام إليهم بالحكمة والموعظة الحسنة، والصحابة –رضوان الله عليهم جميعاً– كانوا على أثر رسول الله في هذا الباب وهم قدوة حسنة لنا، وفي البحث أمور أخرى ذات أهميةPreservation copy of the original JOIS article.
